FryeGuys Pickleball Club: House Rules

• Respect and Courtesy: Treat all players, staff, and visitors with respect and courtesy. Treat others as you would like to be treated.
• Court Behavior: Be respectful of others playing in adjacent courts. Inform players of your presence when passing through their court and do your best to minimize disruption. Always display good sportsmanship.
• Honesty: Make honest and fair line When in doubt, give the benefit of the doubt to your opponent.
• Learning: Embrace opportunities to gain knowledge, experience, and seek to improve. Support each other’s growth in the game.
• Court Safety: Prioritize safety and avoid dangerous play on and off the court. Pause game play if necessary to alert other players of potential tripping hazards or balls from other courts.
• Equipment Use: Use equipment, including paddles, balls, and nets appropriately and with Only players with proper footwear (non-marking soles) should enter the court area.
• Court Clean up: Clean up after yourself – leave the courts, sitting areas and the players’ areas in the same condition as you found them.
• Court Waivers: You must complete a waiver form prior to playing.

These rules are intended to ensure a safe, fun and welcoming environment for everyone. It is important to follow these guidelines to maintain a positive and enjoyable experience for all players.

General Membership Obligations:

Memberships at FryeGuys Pickleball Club (“FryeGuys”) are non-transferable and non-refundable, except where explicitly stated in this agreement. By becoming a member, you agree to adhere to all rules, policies, and guidelines set forth by FryeGuys, which may be updated periodically at FryeGuys’ discretion.

Facility Usage Policies:

• Access & Hours

Members have access to the FryeGuys facility during operating hours, as posted on the website. Special events outside of normal operating hours may require additional fees or reservations for attendance.

Access to the facility is accomplished by an access key pad for members. The

initial “set up” fee covers the cost of the access card. If the access card is lost or damaged and an additional card is needed, there will be a $10 fee incurred. In addition, if a card is lost or stolen, please notify FryeGuys management immediately so the lost card can be disabled.

Memberships:

FryeGuys has two levels of membership to offer – Blue and Green. Both of these memberships are considered annual and both of these levels have two choices in payment to the club – paying a full year in advance or paying a monthly fee as the year progresses.

Paying the total membership cost up front, for Blue or Green levels, will be referred to as ‘annual memberships’ in this document. Those paying monthly for the entire year will be referred to as ‘monthly memberships’ in this document.

• Players looking for a monthly membership with the monthly auto-renew discount also have a one-year commitment. Players who select this option are required to pay throughout the entire membership year through monthly
• Annual and monthly members who incur an illness, injury, or for some other extenuating circumstances that prevents them from using their membership for a period of one month or more may request to have their

membership paused. The request to do so must be submitted in writing to and approved by FryeGuys management. (See page 6 for more information.)

• The term of your FryeGuys Pickleball Club (aka “FryeGuys”) membership plan begins on the date of the purchase of your membership plan. Or if FryeGuys is not yet open, the date that the Club opens for business (the ‘start date’) and continues for a period of thirty (30) days for the monthly plan or for a period of three hundred and sixty four (364) days for the annual
• Your plan membership will automatically renew and continue on a monthly basis for the month-to-month Plan, and on an annual basis for the annual plan, in accordance with the automatic renewal terms below, until you expressly cancel it, or until we terminate it.

Automatic Renewal Terms and Cancellation:

You agree that your Membership will have an initial term of either one-month for the Month-to-Month Plan and will then automatically renew for successive

one-month terms; or a one-year term for the Annual Plan. Each Plan will automatically renew for successive terms equal in length to your Plan’s initial term until it is cancelled or terminated.

Month-to-Month Plan Membership: you may cancel your Month-to-Month Plan membership within the first 15 days after the Start Date using the online cancellation/termination method described below, and you will receive a refund of pre-paid fees, less 20% of the ‘undiscounted’ annual fee. You agree that the initial term of your Plan will start on the Start Date. You agree that, on the date of each automatic renewal, the then-current membership price, plus any then-applicable taxes, fees, and charges, will be charged to your payment method on file. You understand that, if you do not want your Month-to-Month membership to renew, you must cancel/terminate it at least thirty (30) days before the next automatic renewal date. You understand that you may cancel or terminate your Month-to-Month Plan membership for any reason by contacting FryeGuys directly.

Pausing a Membership:

Memberships can be paused for any reason for a reduced monthly fee.* Paused accounts will always start on the first day of the next billing period and will last at minimum one month. The membership will remain ‘paused’ until the member notifies FryeGuys that they would like to reactivate their membership – maximum three months. No prorated balance will be applied to the member’s account for paid dues. To request a membership pause, members must

complete a Membership Pause Request which will provide FryeGuys with their first and last name, club location and reason for the pause. No reactivation fee will be due upon membership reactivation and the monthly fees will resume at the rate that was in effect prior to the pause.

Annual Plan Membership:

You may cancel your Annual Plan membership, within the first 15 days after the Start Date using the online cancellation/termination method described below you will receive a refund of pre-paid fees, less 20% of the actual ‘undiscounted’ annual fee. You understand that, if you do not want your membership to renew, you must cancel/terminate it at least thirty (30) days before the next automatic renewal date. You understand that you may cancel or terminate your membership for any reason by contacting your FryeGuys directly.

Membership Cancellation by Member:

Members enrolled on a month-to-month basis may cancel their membership by providing written notice to FryeGuys management at least thirty (30) days prior to the next billing date. Memberships will remain active through the end of the paid billing period, and no partial refunds or credits shall be provided. Annual memberships (pay-in-advance) are non-refundable unless approved by FryeGuys management at their sole discretion due to exceptional circumstances.

• FryeGuys reserves the right to cancel, suspend, or revoke a membership or deny club admission to any Member at any time for any reason.

Cancellation/Termination, suspension, or revocation of club privileges under a membership plan due to violation of FryeGuys policies or rules, may, at

FryeGuys’ sole discretion, result in you being barred from visiting FryeGuys without any refund or prepaid fees.

• In the event that a membership expires due to a lapse in payment of monthly membership dues for longer than 15 days, the member will be required to pay a $50 reinstatement fee to be able to rejoin at the current

Upgrades:

A Member wishing to upgrade his/her membership must choose a membership of greater value than the original Club membership, and the difference in prices shall be due on the day of the upgrade. Each guest wishing to upgrade his/her ticket to a membership must be present at the time of the upgrade transaction and request the upgrade on the same day of purchase. Request an Upgrade

Eligibility and Conditions:

FryeGuys reserves the right to request additional forms of identification verification.

Memberships are nonrefundable, nontransferable and remain the property of FryeGuys. Restrictions apply including, but not limited to, capacity constraints and other closures. Memberships do not guarantee admission, especially during high attendance periods. Memberships may not be used for commercial purposes and are void if altered or misused. All questions or disputes regarding an individual’s eligibility, the earning/use/conversion of credits, or a Member’s compliance with this Agreement will be resolved by FryeGuys at its sole discretion.

Certain Limits and Restrictions:

Your Plan cannot be combined with any other offers, deals, discounts, or promotions. Use of the Club’s pickleball courts are subject to reservations, and walk-in use of the pickleball courts may be limited or restricted by the Club.

Membership does not guarantee use of a pickleball court, and Members may have to wait an indeterminate period to use a pickleball court. Unless otherwise expressly specified, membership does not include private events (including birthday or other parties, team or league events and parties, corporate events, group events) or events that require separate admission. Membership does not guarantee admission, especially during high attendance or other closure periods.

Additional Agreements and Covenants:

You will maintain an active credit card or debit card authorized for payments (“Payment Method”) under your membership Plan;

You have the authority to bind each individual and each individual’s membership plan added to your Payment Method to this Agreement;

• All individuals and membership Plans added and paid for under your Payment Method will be regarded as active members and membership Plans until you cancel each membership, in

accordance with the cancellation terms described herein. NOTE: you must identify each individual and their membership Plan when canceling a membership; FryeGuys will NOT automatically cancel all membership Plans attached to your Payment Method;

• you will promptly notify FryeGuys of any change in your Payment Method information;
• you are an authorized user of the Payment Method used to purchase this membership, and you will not dispute the scheduled transactions with your bank or credit card company so long as the amounts charged are in accordance with the terms and conditions of this Agreement;
• you understand that FryeGuys will not charge you a fee for authorizing recurring payments, but that your financial institution may charge you a fee for accepting and processing electronic debit transactions;
• in the event the credit card provided is declined, you grant FryeGuys the permission to re-submit the card for payment

Court Reservations:

• All reservations, clinics, events, lessons and/or private courts must be paid for at the time of booking by the ‘reservation owner’, who must also be present for the event, and are all subject to the following cancellation
• Player court reservations made in advance may receive a full refund when cancelled at least 24 hours in advance.
• There are no refunds for player court reservations when cancelled less than 24 hours before the day of play.
• No shows will not receive
• For court reservations that are part of special events booked through FryeGuys management, a full refund is given with a 7-day cancellation No refund for cancellations with less than 7-day notice.
• Refunds will be issued back to the player’s account

Courses, Classes, Clinics:

• For registrations to attend these educational activities, a full refund is given less a 10% administrative fee when the registration is cancelled by the

player with at least 24 hours’ notice. If cancelled within less than 24 hours of the activity, there will be no refund.

• No shows will not receive

Private Lessons:

• For reservations made through FryeGuys, a full refund is given when the reservation is cancelled with at least 24 hours’ Less than 24 hours, no refund. The instructor must be notified directly.
• No shows will not receive

Tournaments:

• Players (a team) may cancel their registration up to 7 days before the start of the tournament for a full There is no refund when cancelling less than 7 days before the tournament start date.
• If a player(s) withdraws from one or more events but remains in other events in the tournament, they will receive a refund for each withdrawn event from which they have withdrawn from without being charged an administration fee.
• Anytime before 7 days, players may seek to transfer the registration to another A $10 transfer fee must be paid to FryeGuys to cover in part or whole the nonrefundable software service fee. It is up to the two individuals to work out payment reimbursement between themselves. If

T-shirts are being given out at the tournament it may not be possible for the replacement individual to receive a shirt other than the original size ordered.

• A full refund will be given if FryeGuys cancels the tournament for reasons within our control, e.g., because the facility is not in playable condition or insufficient registrations, or lack of personnel to conduct the tournament.

Address Change:

You must promptly report to FryeGuys in writing a change in your address. Changes can be made only by updating your information at the Club or by phone.

Guest Policy:

• If a member is bringing a guest, the guest must be with the member at the designated play time. If the guest is spectating only and not playing, no guest fee is required. If the guest is playing, there is a $10 fee to play. A guest is only allowed to play two times per year, before a membership is required. All guests are required to sign the liability waiver at the front desk before entering the club.
• A blue-level member is allowed two guest passes per year, while a green-level member is allowed one guest pass per year.

Liability Waiver:

Members participate in activities at FryeGuys at their own risk. FryeGuys is not liable for personal injury, property loss, or damages incurred during facility use. By signing up for a membership and signing the waiver form, members agree to release and hold harmless FryeGuys, its staff, and affiliates from any claims or liabilities arising from participation in club activities or the use of its facilities.

Injuries:

If you are injured while in the facility, please seek immediate assistance from a staff member. The facility is not responsible for, nor will it consider reimbursement of, member medical costs, including charges a member may incur for emergency response services, ambulance, etc., in the case of a medical event or emergency that occurs on the premises. A brief summary of the incident/injury will be completed by a staff member and will be saved in FryeGuys’ files.

Player Safety:

No glass or other hazardous materials are allowed on the courts. Children under the age of 12 must be accompanied by an adult at all times. The club reserves the right to refuse services to anyone who violates club policies and procedures.

Property Responsibility:

The facility is not liable or responsible for any lost, stolen, or damaged property, whether from cubbies, vehicles, or other locations on the premises. Participants are advised not to bring or store valuables on the premises. All items left on court

premises at the end of each day, or turned in by other members, will be stored in a lost and found bin. That bin is emptied and donated to charity on the first of every month. Members are responsible for reclaiming items as soon as they are aware they are missing to avoid having them donated.

Dress Code:

Shirts must be worn and sports bras must be covered at all times while on club premises. Proper court shoes must be worn and we strongly suggest protective eyewear be worn while playing pickleball.

Member Operated Activities:

Members may not organize their own informal or formal sports leagues, tournaments, or programs within the facility. Teaching private or personal lessons in the facility is also prohibited unless authorized by FryeGuys management.

Drilling & Ball Machine:

Drilling is allowed between players on private or reserved courts during non-peak hours. Outside ball machines permissions are generally limited to specific courts. Be sure to ask FryeGuys management about the parameters.

Photo and Media Policy:

Members acknowledge and agree that photos or videos may be taken during activities or events at FryeGuys Pickleball Club. These photos or videos may be used for promotional purposes, including but not limited to social media, marketing materials, and website content. If you do not wish to be included in such media, please notify staff in advance.

Wireless Network Usage:

By accessing the facility’s wireless network (as “guest”), you agree not to use it to transmit any material that violates any applicable laws. The facility may block access or terminate the wireless service at any time and for any reason and assumes no liability for doing so. Information about your usage of the network may be recorded and used or disclosed when appropriate to comply with the law or to protect the rights, property, or safety of the facility.

Smoke & Vape Free Facility:

The FryeGuys facility is considered a smoke and vape free facility. Please exit the facility and move away from the front door before engaging in either of these activities.

Privacy Policy:

FryeGuys collects personal information during registration, including name, contact information, and payment details. This information is used solely to provide services and manage memberships.

●  Data Protection

Your personal information is stored securely and will not be shared with third parties without your consent, except as required by law.

Policy Changes:

FryeGuys reserves the right in its sole discretion to modify or update this Agreement and/or change, alter, or discontinue the Plan, Club services, entertainment or attractions, operating hours, and any reward or special status Plans at any time and without notice to members beyond updating this Agreement. If we make changes, we will attempt to provide reasonable notice of such changes, such as by sending an email notification or posting an announcement on our website.

Governing Law:

This Agreement is governed by the laws of the State of the FryeGuys Pickleball Club from which you purchased your membership Plan is located, without regard to the conflicts of laws rules of any jurisdiction. Any dispute, claim or cause of action arising out of or concerning the interpretation or effect of this Agreement and/or your participation in the Plan, except where prohibited, shall be resolved individually, without resort to any form of class action. You agree to the personal jurisdiction, subject matter jurisdiction, and venue of these courts.
